Children’s Privacy Policy

Makey Makey LLC (“Company,” “us,” “our,” and/or “we”) has developed the site located at labz.makeymakey.com (the “Site”) with the goal of creating an enjoyable and sage experience for all users. This Children’s Privacy Policy is here to answer your questions regarding out practices with respect to children. When we refer to children in this Children’s Privacy Policy, we are referring to children under 13. When we refer to parents, we use that term to refer both to parents and legal guardians. In this Children’s Privacy Policy, references to “you” and “your” refer to you as a parent.

  1. Information We Collect About Children

    As noted in our main Privacy Policy, “Personal Information” refers to information that can be used to personally identify a particular individual. For children, this information may include:

    • Name;
    • Home or other physical address;
    • Telephone number;
    • Email address;
    • Social Security Number;
    • Social media log-in information or other online contact information (including a screen name, if the screen name functions as online contact information);
    • IP addresses and persistent device identifiers that can be used to recognize a user over time across different websites;
    • A photo, video, or audio file containing a child’s image or voice;
    • Geolocation information that can be used to identify a street name and city or town; and/or
    • Other information that can be combined with the above identifying information and used to identify a particular person.

    Children can browse the Site and view some of its content without providing us with Personal Information.

    When users ask to join the Site, we collect a date of birth to provide the appropriate experience. If a user is a child, we then collect a parent email address and the child’s initials to notify you that your child wishes to use the site. We also provide a parent username and password for login purposes. Parents must opt in to their own account in order to give permission for their child’s use, and to create and connect to their child’s account. We may ask you to provide information about your child in order to create an account for them. This includes an image of your child and their age. This information can only be seen by you on your logged in account.

    Once a child’s account is created, we use the “Email plus” method of verification to permit the child to have an account in which they can upload content. Using “Email plus,” we request, in a direct notice sent to the parent’s online contact address, that the parent provide consent in a return message, and we then confirm that consent by additional contact with the parent. Only the child and parent having access to this account will be able to view this information, which is only used for internal purposes and is not disclosed to third parties or made publicly available.

    If a parent ignores a consent request or refuses to register their child, we will promptly delete all information obtained from the child.

    Except as described above, we don’t knowingly collect Personal Information from children who view the Site, or make any Personal Information the child has provided public, unless we have obtained verifiable parental consent.

    Once we have parental permission and a child has joined the Site as a user, the Site permits a child to type in responses to questions in open text fields and take pictures and video to record that an action was completed, both of which may constitute Personal Information. In addition, a child may respond to multiple choice questions and record the date a process was finished. Only the child’s parent can view the information submitted by a child.

    We also use some passive technologies, such as cookies and web beacons, to monitor traffic on the Site. These technologies may collect demographic information, which may be associated with a child’s personal information that we have collected as we have disclosed in this Children’s Privacy Policy. See the “How We Collect and Use Other Information” section of our general Privacy Policy for more information about how cookies and web beacons work.

  2. How We Use a Child’s Personal Information

    Until we receive your verifiable parental consent, we use the contact information gathered from a child only to obtain your consent to our information collection practices.

    Once we have parental consent, we may use a child’s Personal Information:

    • to permit him or her to use the Site’s various functionalities;
    • to respond to his or her inquiries;
    • to personalize the child’s experience on the Site, such as by presenting projects and products tailored to him or her; and/or
    • for our business purposes, such as data analysis, audits, developing new products and services, enhancing our website, improving our services, identifying usage trends and determining the effectiveness of our promotional campaigns.

    If you would like to opt out of having your child receive any promotional messages, you may do so by visiting your account profile settings or contacting us.

  3. When We Share a Child’s Personal Information

    Once we have received parental consent, a child’s Personal Information may be disclosed:

    • to our third party service providers cwist, Inc. d/b/a Workbench (“Workbench”), Google Analytics and Amazon, who provide services such as website hosting, data analysis, infrastructure provision, IT services, customer service, email delivery services, auditing services and other similar services, to enable them to provide services. We have not given these providers permission to share user information with any other third parties. See the “Third Parties Who May Collect or Store Children’s Personal Information” section of this Children’s Privacy Policy for more information about Workbench, Google Analytics, and Amazon.
    • to other third parties hired to assist us with internal service and support operations (such as online product fulfillment, email services, Site moderation, and technical support). We require these entities to agree to maintain the confidentiality, security, and integrity of the Personal Information they obtain from us.
    • to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings). Any such transfer will require the receiver to uphold this Children’s Privacy Policy.

    In addition, we may use or disclose a child’s Personal Information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside the child’s country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside the child’s country of residence; (d) to enforce our Site terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, the child or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

  4. Your Choices Regarding Your Child’s Personal Information

    If you would like to review the Personal Information your child has provided to us, or if you would like to ask us to cease collecting Personal Information from your child, make no further use of the Personal Information we have collected from your child, or delete the Personal Information we have already collected from him or her, you may contact us at privacy@joylabz.com. In your request, please include your name, your child’s name and your email address, and specify clearly the action you would like us to take. We will try to comply with your request as soon as reasonably practicable.

  5. Information for Educators

    A school may sign up a classroom and a teacher may add a child by creating a username and password and providing age, gender, grade and first name, first initial of last name. The child’s information is not public and is not shared with any third parties or with anyone outside of the school context.

    If a school or teacher wishes to publish a child’s creations with the community or outside of the classroom we will seek full verifiable consent from the parent, and the information we collect will be subject to this Children’s Privacy Policy. A parent can review the information about their child at any time by contacting us at privacy@joylabz.com.

    Students who are 13 years or older can sign up with their own email address and join a class using a class name provided by a teacher.

  6. Changes to our Children’s Privacy Policy

    We may amend this Children’s Privacy Policy at any time. If we do, we will provide you with notice by email of any material changes in the way we collect, use, or share children’s personal information. Parents, it is your responsibility to ensure that the contact information you have provided to us is up to date.

  7. Third Parties Who May Collect or Store Children’s Personal Information

    To help us provide you with the best service we work with a third party analytics provider called Google Analytics. This company helps us to understand your use of the Site. This information is for internal use only and can’t be shared. It’s just for us to help us improve our services for you.     To help us host information and deliver emails we use Amazon. Amazon does not access our user information and does not share it with any other third parties. For more information on this service please see their privacy policy here: https://aws.amazon.com/privacy/.

    To provide this platform to our users, we license it from Workbench. Workbench hosts the Site, including information collected from users, including Children. The collection and use of information on this Site is subject to Workbench’s Privacy Policy.

Makey Makey LLC (“Company,” “us,” “our,” and/or “we”) is concerned about privacy issues and wants you to be familiar with how we collect, use and disclose information. This Privacy Policy describes our practices in connection with information that we collect through the site located at labz.makeymakey.com (the “Site”). By providing Personal Information to us or using the Site, you agree to the terms and conditions of this Privacy Policy.

Our site is for use by both children and adults. Please refer to our Children’s Privacy Policy for more information about the additional protections we provide for children under the age of 13 who visit the Site.

  1. Personal Information We Collect

    “Personal Information” is information that identifies you as an individual, such as:

    In order to create an account on the Site, we collect an email address and password. We may permit you to sign into the Site through your social media account. If you choose to do so, we receive your profile information and other information you have chosen to make public on your social media account. This could include, for example, your email address, name, picture, gender, user ID and list of friends.

    We will collect other information through your use of the Site, such as through the information that you post with your submissions and projects on the Site, and information that you post in forums and other interactive features of the Site on message boards, chat, profile pages and blogs and other services to which you are able to post information and materials. You are in control of what information you choose to post in this respect. Please note that any information you post or disclose through these services will become public and may be available to visitors to the Site and to the general public, even after you delete it (such as on cached pages). We urge you to be very careful when deciding to disclose your Personal Information, or any other information, on the Site.

    We may combine your Personal Information with information that we receive from and about you, online and offline, including from third parties.

  2. How We Use Personal Information

    We may use Personal Information:

  5. Other (Non-Personal) Information

    “Other Information” is any information that does not reveal your specific identity or does not directly relate to an individual, such as:

    • Browser information;
    • Information collected through cookies, pixel tags and other technologies;
    • Demographic information and other information provided by you; and
    • Aggregated information.

  6. How We Collect and Use Other Information

    We and our third party service providers may collect Other Information in a variety of ways, including:

    • Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system version and Internet browser type and version. We use this information to ensure that our Site functions properly.
    • Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited and language preferences. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience while visiting the Site, as well as for online tracking purposes. We also use cookies to gather statistical information about the usage of the Site in order to continually improve its design and functionality, understand how customers use it and to assist us with resolving questions about it. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to decline the use of cookies. If you choose to decline cookies, some or all of the features, functionality and promotions available through the Site may not be available to you.
    • Using pixel tags and similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Site pages and HTML-formatted email messages to, among other things, track the actions of Site users and email recipients, measure the success of our marketing campaigns and compile statistics about Site usage and response rates.
    • IP Address: Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited. We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.
    • From you: Information such as your location, as well as other information, such as your preferred means of communication, is collected when you voluntarily provide this information. Unless combined with Personal Information, this information does not personally identify you.
    • By aggregating information: Aggregated Personal Information does not personally identify you (for example, we may aggregate Personal Information that is then de-identified, to calculate the percentage of our users who have a particular telephone area code).

  7. How We May Disclose Other Information

    We may use and disclose Other Information for any purpose, except where we are not permitted to do so under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then, in addition to the uses listed in the “How We Collect and Use Other Information” section above, we may use and disclose Other Information for all the purposes for which we use and disclose Personal Information.

    In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.

  8. Third Party Sites

    We may include links to third parties from the website or services. We are not responsible for these companies, and we do not endorse them. Your use of our services may be subject to the terms and conditions and privacy policies of other services that we don’t control such as mobile app stores, mobile software platforms or payment processors. Please be sure to check their privacy policies if you decide to visit them.

    In addition, the third parties that service our Site features may use cookies, alone or with web beacons or other tracking technology, to collect information about you when you use the Site. They may be able to associate the information they collect with your Personal Information, or they may collect information, including Personal Information, about your online activities over time and across other website and online services. They may use this information to provide you with behavioral advertising or other targeted content.

    We cannot control any third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

  9. Do Not Track Requests

    Currently, certain browsers, including Firefox, Google Chrome, Safari and Internet Explorer, offer a “do not track” (or, “DNT”) option. This option, using a technology known as a DNT header, sends a signal to websites visited by the user about the user’s DNT preference, if any, set on the browser. We do not currently commit to responding to browsers’ DNT signals. We cannot make this commitment because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators.

  10. Security

    We use reasonable organizational, technical and administrative measures to protect Personal Information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the “Contacting Us” section below.

  11. Your Choices and Control Over Your Personal Information

    You may opt out from receiving marketing emails from us. If you no longer want to receive update emails from us, you may opt out of receiving them by following the instructions contained in each such email. If you opt out of receiving marketing messages from us, we may still send you important administrative messages.

  13. Jurisdictional Matters

    The Site is controlled and operated from the United States and is not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.

    Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using our Site you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than in your country.

  14. Updates to this Privacy Policy

    We may change this Privacy Policy. The “Last Updated” legend above indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Site. Your use of the Site following these changes means that you accept the revised Privacy Policy.

  15. Notice to California Residents

    If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of Company to third parties for the third parties’ direct marketing purposes.
